Divorce

This is the legal process where you must have a legal reason (grounds for the divorce) for being entitled to end your marriage. A legal reason could be:

• Extreme cruelty and/or gross neglect of duty
• Incompatibility
• Living separately for more than one year

The process may involve such steps as:

• Attending Parenting Classes if there are children involved
• Creating a Separation Agreement - a written document through which all the rights and responsibilities of both parties regarding such matters as property, debts and children will be outlined and agreed upon by both parties.
• Period of Conciliation Counseling - if the Court believes there is a chance of saving the marriage, the divorce will be placed on hold for up to 90 days and all parties will be required to attend therapy.

Dissolution of Marriage

This is a legal process for you if you and your spouse are in TOTAL agreement about:

• Property division - including real estate, personal property, vehicles, bank accounts, stocks/bonds, pensions/retirement/profit sharing plans, vacation homes, recreational equipment, and all other items purchased or acquired during the marriage
• Debt - who will pay what, when and in what amounts
• Spousal Support / Alimony - if there is support then how much is it, when it is paid, how it is paid, is it temporary or permanent
• Children (if involved)
  • Support
  • Custody / Allocation of Parental Rights and Responsibilities
  • Visitation / Parenting Time
  • Medical care decisions, insurance and payment
  • Tax exemptions and credits

Once the Separation Agreement is filed, the dissolution is granted within 90 days. If there are children involved, you are required to attend Parenting Class before the dissolution is granted.
